Arco is posting gas prices lower but they are not posting that their price is based on cash price, can I sue?
Arco is advertising their gas prices lower than everyone else but they are not mentioning that their price is based on a cash price, and this price if ATM card is used then additional charges will apply which is 45 cent per transaction
Can they be sued for that?
Nope.
They are willing to sell it to you at that price. As such, you have no grounds to sue. They are passing through the cost of the use of an ATM card at about what it costs.
If you want the lower price, pay cash.
